This document is a formal proposal (the “Offer”) from the TurtleGuard service (the “Provider”) to enter into a paid services agreement on the terms below with any individual or legal entity (the “Customer”) who accepts them.
Under article 437 of the Civil Code of the Russian Federation this Offer is a public offer. Registering at turtleguard.cloud, topping up the balance or ordering any service counts as full and unconditional acceptance. From that moment the agreement is concluded.
1. Definitions
- Service / Panel — the TurtleGuard platform and the customer area at turtleguard.cloud/panel.
- Services — DDoS protection (L3/L4/L7), request inspection, CDN, authoritative DNS, VPS/VDS rental, domain registration and renewal.
- Balance— the Customer's account in the Panel, from which the cost of services is taken.
- Plan — the set of service parameters and the price published in the Panel.
2. Subject of the agreement
The Provider undertakes to deliver the Services selected in the Panel, and the Customer undertakes to pay for them in the manner and amount set by this Offer and the published prices. The list, composition and price of the Services are defined in the Panel and may be changed by the Provider.
3. How services are delivered
- A service becomes active once it is ordered in the Panel and its cost is taken from the Balance.
- Protection is switched on by changing an A record or delegating the zone to the Provider's name servers; the Customer does not have to migrate any infrastructure.
- VPS/VDS are provisioned automatically; access is given through the Panel and SSH/console.
- Basic L3/L4 DDoS protection is included with every VPS/VDS plan at no extra cost.
4. Price and payment
- Prices are shown in the Panel in US dollars (USD) and are the ones current at the time of order.
- Payment is made in advance by topping up the Balance through the available payment methods.
- The cost is taken from the Balance at the moment of ordering or renewal (for recurring services — for the billing period chosen).
- If the Balance is short, delivery of the service may be paused until it is topped up.
5. Rights and obligations
The Provider undertakes to keep the Services working to the stated parameters and to give technical support through the ticket system in the Panel.
The Customer undertakes to give accurate details, not to use the Services for unlawful activity (spam, phishing, hosting malware, attacks on third parties) and to keep their account secure.
The Provider may pause or stop the Services if the Customer breaks this Offer or the law.
6. Liability and service level
- The Provider makes reasonable efforts to keep the network available; the target availability is stated for the relevant plans.
- The Provider is not liable for losses caused by the Customer's own actions, by failures on the Customer's server, or by circumstances beyond reasonable control.
- Total liability is limited to the price of the relevant Service for the billing period in which the incident occurred.
7. Refunds
- Protection and VPS/VDS come with a 7-day money-back guarantee from first activation.
- Registered domain names are not refundable once registered, because the operation cannot be reversed at the registrar.
- An unused Balance can be returned on written request, less the costs the Provider has actually incurred.
8. Personal data
Personal data is processed under the Privacy policy. By accepting this Offer the Customer consents to the processing of their data to the extent needed to deliver the Services.
9. Term and changes
- The Offer takes effect when published and stays in force until the Provider withdraws it.
- The Provider may change the terms and the prices; a new version takes effect when published in the Panel or on the site.
- Continuing to use the Services after a change means the Customer accepts the new version.
